1. Agreement to Terms

Welcome to ForVibeApp. These Terms of Use ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and ForVibeApp ("Company," "we," "us," or "our") governing your access to and use of the ForVibeApp platform, website, and services (collectively, the "Service").

By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use our Service.

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

2. Description of Service

ForVibeApp is an all-in-one toolkit for app developers that provides the following features:

• Landing Page Builder: AI-powered tools to create and host landing pages with customizable templates
• App Store Management: Unified dashboard to manage App Store Connect and Google Play Console listings, metadata, and localization
• Screenshot Studio: Tools to create, customize, and localize app store screenshots with device mockups
• Pricing Management: Tools to manage in-app purchase pricing across multiple regions and currencies
• Legal Document Generator: AI-powered wizard to generate Privacy Policies, Terms of Use, EULAs, and Disclaimers
• Customer Support: Built-in mailbox with AI-powered response suggestions
• Review Management: Centralized dashboard to view and respond to app store reviews with AI assistance

3. Eligibility

To use our Service, you must:

• Be at least 18 years of age or the age of majority in your jurisdiction
• Have the legal capacity to enter into binding contracts
• Not be prohibited from using the Service under applicable laws
• Provide accurate, current, and complete information during registration
• Maintain the security of your account credentials

By using our Service, you represent and warrant that you meet these eligibility requirements.

4. Account Registration and Security

4.1 Account Creation

To access certain features, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access or security breach
• Accept responsibility for all activities under your account

4.2 Account Termination

We reserve the right to suspend or terminate your account at any time for:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Extended periods of inactivity
• Non-payment of fees
• Any reason at our sole discretion

5. Subscription Plans and Payments

5.1 Plans and Pricing

ForVibeApp offers the following subscription plans:

• Free Plan: Limited access with 1 project and 200 one-time AI credits
• Pro Plan: $9.99/month with unlimited projects, +500 monthly AI credits, premium templates, custom domains, and priority support

5.2 AI Credits

AI credits are used for AI-powered features including translations, content generation, and automated responses. Free users receive 200 credits upon signup. Pro users receive +750 credits added to their balance each month. Credits never expire and accumulate in your account.

5.3 Payment Terms

• All fees are in U.S. Dollars (USD) unless otherwise stated
• Subscriptions are billed monthly in advance
• Payment is processed through Stripe, our third-party payment processor
• You authorize us to charge your payment method on a recurring basis
• Failed payments may result in service suspension or termination

5.4 Refund Policy

All subscription fees are non-refundable except as required by law or at our sole discretion. We do not provide refunds or credits for partial months of service, upgrade/downgrade refunds, or refunds for months unused with an open account.

5.5 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period. You will retain access to Pro features until the end of the paid period.

5.6 Price Changes

We reserve the right to modify our pricing. We will provide at least 30 days' notice of any price increases. Your continued use of the Service after the price change constitutes acceptance of the new pricing.

6. User Content and Intellectual Property

6.1 Your Content

You retain all ownership rights to content you create, upload, or submit through the Service ("User Content"), including:

• Project descriptions and metadata
• Screenshots and images
• Landing page content
• App store presence
• Generated legal documents

6.2 License to Use Your Content

By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display your User Content solely for the purpose of providing and improving the Service. This license terminates when you delete your content or account, except for content that has been shared with others or is retained in backups.

6.3 Our Intellectual Property

The Service, including its design, features, functionality, software, templates, and content (excluding User Content), is owned by ForVibeApp and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our express written permission.

6.4 AI-Generated Content

Content generated by our AI features (landing pages, legal documents, translations, etc.) is provided to you for your use. While you have the right to use AI-generated content, you are responsible for reviewing, editing, and ensuring its accuracy and compliance with applicable laws before publishing or using it.

7. Acceptable Use Policy

You agree not to use the Service to:

• Violate any applicable laws, regulations, or third-party rights
• Upload or transmit viruses, malware, or other malicious code
• Engage in fraudulent, deceptive, or misleading activities
• Harass, abuse, threaten, or intimidate others
• Infringe on intellectual property rights of others
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the Service or servers
• Use automated systems (bots, scrapers) without permission
• Resell or redistribute the Service without authorization
• Create accounts through automated means or under false pretenses
• Upload content that is illegal, obscene, defamatory, or hateful
• Violate App Store or Google Play policies

8. Third-Party Integrations

8.1 App Store Integrations

Our Service integrates with Apple App Store Connect and Google Play Console. By connecting these services:

• You authorize us to access and modify your app listings on your behalf
• You remain responsible for compliance with Apple and Google policies
• You must provide valid API credentials and maintain their security
• We are not responsible for actions taken by Apple or Google

8.2 Third-Party Services

The Service may contain links to third-party websites or integrate with third-party services. We are not responsible for the content, privacy practices, or terms of these third parties. Your use of third-party services is at your own risk.

9. Disclaimers and Limitations of Liability

9.1 Service Provided "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

9.2 No Guarantee of Results

We do not guarantee that:

• The Service will meet your specific requirements or expectations
• The Service will be uninterrupted, timely, secure, or error-free
• AI-generated content will be accurate, complete, or legally compliant
• Any errors or defects will be corrected
• The Service will be compatible with all devices or platforms

9.3 AI-Generated Content Disclaimer

AI-generated content (including legal documents, translations, and automated responses) is provided as a starting point and convenience tool. You are solely responsible for reviewing, editing, and ensuring the accuracy and legal compliance of all AI-generated content before use. We strongly recommend consulting with qualified professionals (lawyers, translators, etc.) for important documents.

9.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORVIBEAPP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, WHETHER IN AN ACTION IN CONTRACT, TORT, OR OTHERWISE, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless ForVibeApp, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your User Content
• Your violation of any third-party rights
• Your violation of applicable laws or regulations

11. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data collection and use practices.

You are responsible for ensuring that your use of the Service complies with applicable data protection laws, including GDPR, CCPA, and other privacy regulations.

12. Termination

12.1 Termination by You

You may terminate your account at any time through your account settings or by contacting us. Upon termination, you will lose access to your account and all associated data.

12.2 Termination by Us

We may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including:

• Breach of these Terms
• Fraudulent or illegal activity
• Non-payment of fees
• At our sole discretion

12.3 Effect of Termination

Upon termination:

• Your right to use the Service immediately ceases
• We may delete your account and data after 30 days
• You remain liable for any outstanding fees
• Provisions that should survive termination (including disclaimers, limitations of liability, and indemnification) will continue to apply

13. Dispute Resolution and Arbitration

13.1 Informal Resolution

Before filing a claim, you agree to contact us at legal@forvibe.app to attempt to resolve the dispute informally. We will attempt to resolve the dispute within 60 days.

13.2 Binding Arbitration

If informal resolution fails, any dispute arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the United States. You and ForVibeApp agree to waive the right to a jury trial or to participate in a class action.

13.3 Exceptions

Either party may seek injunctive or other equitable relief in court to prevent actual or threatened infringement or misappropriation of intellectual property rights.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict of law provisions.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on our website
• Updating the "Last Updated" date
• Sending email notification for significant changes

Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service and terminate your account.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ForVibeApp regarding the Service and supersede all prior agreements.

16.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

16.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.

16.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, or internet service provider failures.
